Nana Pearl is a fictional, AI-generated character. The products are created and sold by the business identified above.
2. Scope
These Terms apply to consumers, meaning individuals buying for purposes outside their trade, business or profession. You must be at least 18 years old, or have the consent of a parent or guardian, to place an order. By placing an order, you accept these Terms. The version in force on the day of your order applies. We keep a copy, and you can save or print these Terms at any time from this page.
3. Products
We sell digital content: downloadable guides in PDF format (a print version and a fillable version), and some free guides. No physical item is shipped. The main characteristics of each product (number of pages, format, contents, compatible devices) are described on its product page, in accordance with Article L111-1 of the French Consumer Code (Code de la consommation).
Technical requirements: a device able to open PDF files (computer, tablet or smartphone), a free PDF reader, and, for the print version, a printer using US Letter paper. The fillable version works in PDF readers that support form fields, and in apps such as GoodNotes or Notability. Please check these requirements before purchasing.
Our guides contain general fitting and sewing information. They are not medical advice.
4. Prices
Prices are shown in the currency of your market (for example US dollars for the United States, euros for France), inclusive of all applicable charges. VAT is not applicable (Article 293 B of the CGI). No delivery fee applies. Depending on your bank or card issuer, currency conversion fees may apply. These are set by your bank, not by us.
The price that applies is the one displayed at the moment you confirm your order. Discount codes apply only under the conditions stated when they are issued.
5. Ordering
- For a paid guide, tick the box on the product page to give your express consent to immediate delivery and to acknowledge the loss of your right of withdrawal (see section 8).
- Add the guide to your cart.
- Enter your email address and billing details.
- Review your order summary and the total price, and correct any errors.
- Click the order button, which states that the order involves an obligation to pay.
The contract is formed when your payment is accepted. We then send you a confirmation email on a durable medium, including the details of your order, these Terms and confirmation of your consent and waiver (Articles L221-13 and L221-14 of the French Consumer Code). Contracts are concluded in English.
6. Payment
Payment is due in full at the time of order, by [À COMPLÉTER : moyens de paiement activés, ex. credit/debit card, Apple Pay, Google Pay, PayPal]. Payments are processed securely by [À COMPLÉTER : prestataire de paiement, ex. Shopify Payments]. We never see or store your full card details.
7. Delivery of your guide
Your guide is available immediately after payment: a download link appears on the order confirmation page and is sent to the email address you provided. If you have not received it within 24 hours (check your spam folder), contact us at [À COMPLÉTER : e-mail] and we will send it again at no cost. See Downloads & Delivery.
Under Article L221-15 of the French Consumer Code, we are fully responsible for the proper performance of the contract, including delivery of your files.
8. Right of withdrawal
As a rule, consumers have 14 days to withdraw from a distance contract without giving a reason (Article L221-18 of the French Consumer Code).
However, under Article L221-28, 13° of the French Consumer Code, this right does not apply to digital content not supplied on a tangible medium when supply has begun with your prior express consent and your express waiver of your right of withdrawal.
When you order a paid guide, we ask you, on the product page and before you add the guide to your cart, to (1) expressly agree that the guide is made available to you immediately, and (2) expressly acknowledge that you therefore lose your right of withdrawal. Once you have given this consent and the download link has been made available, you can no longer withdraw.
If this consent was not obtained, or was not confirmed to you on a durable medium, you keep your 14-day right of withdrawal. You can exercise it by sending us an unambiguous statement or the model withdrawal form available on our Refund Policy page. We will then refund you within 14 days by the same means of payment (Article L221-24 of the French Consumer Code), at no cost to you.
This section does not affect your legal guarantees (section 9), which always apply.
9. Legal guarantees
All our guides benefit from the legal guarantee of conformity for digital content (Articles L224-25-12 et seq. of the French Consumer Code) and the legal guarantee against hidden defects (Articles 1641 to 1649 of the French Civil Code). These guarantees apply regardless of the right of withdrawal and cannot be limited or excluded.
In practice: if a file is missing, corrupted, does not open, does not match its description, or a fillable field does not work as described, contact us at [À COMPLÉTER : e-mail]. We will fix it free of charge (corrected file or new link). If we cannot do so within a reasonable time, or if the defect is serious, you can obtain a price reduction or a full refund.
For consumers in France, the mandatory statutory information is reproduced below in French:
10. Licence of use
When you buy or download a guide, you receive a personal, non-exclusive, non-transferable licence to use it for your own private, non-commercial purposes. You may print it and fill it in for yourself as many times as you like.
You may not resell, share, distribute, publish online, upload to file-sharing services, translate, modify for distribution, or use the guide or its illustrations for commercial purposes, including to train AI models, without our prior written consent (Articles L122-4 and L335-2 of the French Intellectual Property Code).
11. Liability
We are responsible for the proper performance of the contract under Article L221-15 of the French Consumer Code. We are not liable for failures caused by you, by an unforeseeable and insurmountable act of a third party, or by force majeure within the meaning of Article 1218 of the French Civil Code. Nothing in these Terms limits our liability where such a limitation is prohibited by law, nor your legal guarantees.
Our guides give general advice. Results depend on your garments, fabrics and skills. Take care when using needles, scissors and other sewing tools.
12. Personal data
We process your personal data to manage your order and, with your consent, to send you our newsletter. Details are in our Privacy Policy and our Cookie Policy.
13. Customer service and complaints
For any question or complaint, contact us at [À COMPLÉTER : e-mail], [À COMPLÉTER : téléphone] or through our contact page. We aim to reply within [À COMPLÉTER : délai, ex. 2 business days].
14. Consumer mediation
In accordance with Articles L612-1 et seq. of the French Consumer Code, if your written complaint to us has not been resolved, you may refer the dispute free of charge to the consumer mediator we have appointed:
[À COMPLÉTER : nom du médiateur de la consommation]
[À COMPLÉTER : adresse postale du médiateur]
[À COMPLÉTER : site internet du médiateur]
You may refer the matter to the mediator within one year of your written complaint to us. Mediation is optional: you may also go to court.
15. Applicable law and jurisdiction
These Terms are governed by French law. If you are a consumer residing in another country, this choice of law does not deprive you of the protection of the mandatory provisions of the law of your country of residence (Article 6 of Regulation (EC) No 593/2008, “Rome I”). In the event of a dispute, and after an attempt to find an amicable solution, you may bring proceedings before the competent courts of your place of residence or of our registered office, under the applicable rules.
16. Changes
We may update these Terms at any time. The Terms that apply to your order are those in force on the date of your order.
